臭罌出臭草,此賬更糊塗——我們不接受高鐵環評





此文經六個團體、393名個人聯署,已於2009年8月21日遞交有關當局,聯署行動經已結束。現時假若大家收到其他聯署行動呼籲,如集資登報聯署,都與OXRA及「臭罌出臭草,此賬更糊塗」的作者無關,懇請注意。

現時OXRA的行動,只有聯絡海外水文專家以研究司法覆核問題一項,希望日後可以將EIA此偽科學的矇騙與迷思,更深化地暴露在公眾面前。

此外,再重申一次,OXRA就興建高鐵的基本立場,是從香港人要反省對萬物與眾生的基本責任出發,故絕對不會認為改改走線、加多幾個站就會令得高鐵可以接受,更絕不會與最終目標是將新界西北發展為副都市及交通樞紐的所謂綠色planner等「專業人士」有所聯繫,或一同搞甚麼對策。

前言

香港的環境影響評估(環評,EIA),是由項目倡議人(project proponent)委託做的,這本身便存在很大的偏差,因為項目倡議人當然是期望工程上馬,所以他們僱用的環評顧問公司(的專家),自然傾向為客戶的工程上馬度身訂做其環評。在商言商,「(專家)一般願意調節他們的論証,去一邊滿足其客戶需要,一邊提高自己的聲譽。」 (Slobodkin 2003, p.188)。本地生態學者群亦清楚指出,由於項目倡議人在生態保育之外別有懷抱,做環評的人「根本就沒有動機去做一個全面的評估」(Fellowes et al. 2002, p.151)。

現時這個「廣深港高速鐵路(香港段)」環評報告(註1) (以下簡稱「高鐵環評」),就是利用香港法例第499章《環境影響評估條例》(EIAO)的研究概要(Study Brief)、技術備忘錄(Technical Memorandum)和指引(Guidance Notes)所預留的空隙去調節論証,以滿足其客戶(港鐵公司)及整個項目的主催人——曾特首的要求。這些法律文件的先天缺陷,將在本文第一部份一一指出;再者,這份高鐵環評不少部份連法律條例規定的最低標準也未達到,這些,我們將在本文的第二部份討論。

另一方面,環評報告旨在硬銷高鐵的痕跡卻處處可見,不惜抄襲政府立場,講出不屬其專業範疇的話語,例如,稱頌高鐵所帶來的社會利益為:替西九製造地標、增強與內地的經濟聯繫、令香港成為珠江三角洲的大門等等。(行政摘要2.10;高鐵環評Table 17.1)

就環評程序而言,這份高鐵環評經一個月的公眾諮詢後就由環保署署長審批,如果公眾所指出的錯謬屆時環保署署長還是視而不見,照樣通過,向工程項目大開綠燈的話,這個部門的信用就徹底破產,亦揭示現政權班子要強行興建高鐵,實在不顧顏面,視法律與公理如無物。

以下,我們會集中評論高鐵環評的生態影響部份,特別是對鐵路北段(即新界西北)的評估,以說明高鐵環評之不能接受,不應接受。


第一部份:高鐵環評利用環評條例Study Brief的先天缺陷,作出失實的評估。


(甲) 欠缺生態角度,使用粗疏調查方法,收集的數據無代表性

(1) 就高鐵工程,環保署發給港鐵公司的Study Brief No. ESB-197/2008,第3.4.8.4多處指出環評須有「生態角度」(ecological perspective),其中的關鍵詞彙包括 “ecological characters of the study area”, “community structure”, “inter-dependence of the habitats and species”, “ecological carrying capacity”,聽上去要求合理。然而,環保署和漁護署又發出EIAO Guidance Notes,去讓環評公司將有關要求化約為毫無生態學根據的操作方法,包括容讓一個以純粹數物種的粗糙方法,去作生態評估,始終無半點「生態角度」所要求的系統研究可言。

(2) 生態學上的系統研究,必須有量化或至少是質性的模型建構及應用(Polis & Winemiller 1996;Forey 1994; Pastorok et al. 2002; Akcakaya et al. 2004; Ferson & Burgman 2000; Soule 1986),去說明物種社群及其環境在時間、空間的變化下的關係,否則,生態影響評估根本就無從談起。而建構這些模型,是包含了對以下元素的研究和理解:生境(habitats)或地景(landscapes)中不同層級的食物鏈、關鍵物種(keystone species)、保護傘物種 (umbrella species)、不同物種間的關係(競爭、互助、捕食、寄生……)、個別物種的生理韌度、年齡結構、性別結構、繁殖力、需要的生境範圍、散佈及遷徙能力、基因差異、近親繁殖及外來入侵品種對物種群落的影響、與其他群落的關係、絕種機率等。

Fellowes等香港生態學者明確表示,現時關於物種在香港生境中的情況的研究十分缺乏,所以他們齊聲呼籲環評必須在退而求其次的情況下,高度重視全球性、地區性、及本地的「受關注物種」,而他們已經在 “Wild Animals to Watch: Terrestrial and Freshwater Fauna of Conservation Concern in Hong Kong” 這份重要文獻中,就著動物保育方面踏出了第一步,列出他們專業研究範疇內的各「受關注物種」,並表示這個表列所包括的物種其實是極之有限的。

然而,這份高鐵環評對各位學者的生態保育呼籲卻充耳不聞。例如,表列中的虎紋蛙(Chinese Bullfrog)無論在全球、地區或本地都正在急遽消失,環評報導了在大江埔擬建的高鐵緊急救援入口的位置錄得此物種,但完全沒有提議要作出保護。此外,對這個「受關注物種」表中所列出的187種昆蟲(註2),也不進行調查,只是取巧地採用了Guidance Note no.10/2004建議的方法——數算蝴蝶和蜻蜓兩個物種。以下集中討論這個方法的嚴重錯謬。

(3) 香港起碼有25個目(genus)、過萬種(species)的昆蟲,根據甚麼生態學術理論,憑數算蝴蝶和蜻蜓便可以反映其他昆蟲的多樣性?事實上,一些外國的研究早已指出,在某一地區不同科(families)的物種會有不同的集中度——對某一物種合適的生境未必同樣吸引其他物種(Prendergast 1997; Prendergast et al. 2003; Lawton et al. 1998; Oertli et al. 2005; Currie 1991),蝴蝶及蜻蜓的多少並不反映其他昆蟲的數量。另一方面,Kremen (1992)在一個有關蝴蝶作為生態指標的研究就指出,蝴蝶數量與濕度和光線有較強關係,但不能反映植物的多樣性及豐富度;另一些研究也指出蝴蝶未能反映環境受破壞的程度(Watt 1998)——很多蝴蝶幼蟲只依賴某一兩種植物寄主,牠們的出現很可能只代表該地點存在這些植物(註3)。

與蝴蝶同屬鱗翅目的蛾,是夜行性昆蟲,而且其中可能很多是本土特有種(endemic species)(Dudgeon & Corlett, 2004, p.217),Fellowes et al.(2002)也列出16種為「受關注品種」,高鐵環評就算要選鱗翅目作為有代表性的昆蟲,又為何遺留了蛾?

高鐵環評說鱗翅目與蜻蜓目與很多其他昆蟲使用同樣生境(高鐵環評3.40),這只說明了做環評的人毫無生物常識(遑論生態常識)。很多昆蟲的分佈很狹窄,無論是成蟲或幼蟲都有較專門的生境要求——鞘翅目的隱翅蟲科就是很細小、較隱秘、生活在特有生境的昆蟲(Dudgeon & Corlett, 2004, p.216);飛行及分佈(dispersal)能力較弱的品種(如很多可能是本土特有品種的竹節蟲)則比蝴蝶及蜻蜓更易受到環境轉變影響(Lande 1987; Pahl et al. 1988)。

(4) 昆蟲在生態系統中擔當非常重要的角色,牠們身為分解者、植食者、肉食者,在生態食物網中轉換能量和循環物質,為其他生物提供食物。Pimm and Raven(2000)估計在未來50年,每100萬種昆蟲之中就有57,000種會絕種,特別是社會性昆蟲(如蜂及蟻),更受威脅(Chapman & Bourke 2001)。全球有關生物滅絕的科學研究顯示,過去估計已有數萬種昆蟲絕種(雖然只有70種被紀錄下來)。可見,所有的環評都不能粗疏、胡亂地處理昆蟲這個範疇。

(5) 除此之外,高鐵環評根本沒有觸及生態網的最低層——分解系統,包括泥層及居於其中大量的生物如彈尾目、甲蟎目、等足目、倍足綱、蚯蚓、線蟲、微生物、真菌等。這些都是健全生態系統中最基本的成份,因為不同的物質需要不同生物的獨特酵素去分解,才能夠成為其他動植物的能量來源(Lee 1993; Stolp 1988; Berry 1993; Orcutt & Nilsen 2000, pp.25-42; Coleman et al. 2004)。


(乙) 對「累積性影響」採用極狹窄定義,反映不出生態後果的嚴重性

(6) EIAO Study Brief 3.4.8.4(vii) (e) 要求考慮同期及已知將進行的工程,從而理解累積性影響(cumulative impacts) 。高鐵環評在討論生態影響時,列出四項(將)同時在附近進行的工程(高鐵環評Table 3.49),指出其中兩項與高鐵工程共同構成的生態影響為低(low),因為那些地方已經發展,也無甚生態價值可言,另一項就只有輕微(minor)影響,因為會架設圍板、採用良好的施工方法,最後一項則在採用良好的施工方法和補償措施之下,根本就毫無累積性負面影響。

(7) 首先,所謂採用良好的施工方法來減低累積性影響,請問這由誰來監察?由誰來跟進?茲展示——

(a) 高鐵牛潭尾段範圍,不久前有一個小型工程,一方面參與了「公德地盤嘉許計劃」,實質上棄置之廢物清晰可見。
















(b) 同址的一個高鐵前期勘察工程的小小地盤裏,毒性廢物隨處放置,所棄垃圾又惹來蒼蠅處處。











見微知著,高鐵工程規模遠比這一、兩個小工程為龐大,需要有系統的協調、精密的管理,「良好的施工方法」才可保證,絕不是環評說做得到就真正做得到。

(8) 所謂地方已經發展,又沒有甚麼生態價值,並從而論證眾工程無累積性負面生態影響,這是一個十分誤導性的說法——正因為需要修復生態時,處理現有的破壞與污染,總遠遠容易過要清理連場破壞與污染造成的局面。何況,在高鐵環評所指的這些「已發展地方」,也發現了好一些罕有甚至受保護的物種,如受國家二級保護的褐翅鴉鵑(Greater Coucal)、數目在急遽減少中的牛背鷺(Cattle Egret)和八聲杜鵑(Plaintive Cuckoo)、群落高度集中的蒼鷺(Grey Heron)和小白鷺(Little Egret)、數目在減少中更只在局部地區繁殖(錦田正是牠的繁殖區)的灰背椋鳥(White-shouldered Starling) (高鐵環評Appendix 3.4; 尹璉等2006, p.130, p.220; Fellowes et al. 2002)。

(9) 除了同期進行的工程,整體環境趨勢及政府政策也必須考慮。珠江三角洲的郊野與農地日益縮小、金融海嘯下政府在全港各區推出更多大小工程、特區政府容讓丁屋政策持續肆虐新界土地、愈加頻繁的大陸—香港之間的運輸交通、以推動生態旅遊為名的破壞郊野活動(註4)、政府部門(基於要擺政治姿勢)在鄉郊大倒蚊油減低了河溪生物多樣性(Dudgeon & Corlett, 2004, p.117)、大幅度清除山坡植被而噴石屎漿等等破壞生態的措施(註5)層出不窮,在在構成Levins所言的「多重的危機」(multiple risks) (Levins 2008, p.45)。這種生態危機的雪上加霜情況,還涉及香港大環境(空氣、水及港口)中,已廣泛存在重金屬及持久性有機污染物(Persistent Organic Pollutants),污染熱點更包括米埔的紅樹林區(駱永明 2007, pp.25-28; Young & Melville 1993)。要評估「累積性影響」,又焉能忽視這些元素?

(10) Technical Memorandum 4.4.3 (a) (iii) 要求環評考慮鄰近地段同期進行的工程——事實上,整個高鐵環評都只考慮施工地點500米範圍內的影響,所以亦只考慮500米範圍內的同期工程,這其實是非常荒謬的。舉例說,水文改變、地下傳聲(震動),就能影響以公里計的範圍(Rushton 2003, p.28; DEFRA 2003, pp.8-9; Freund 2003, p.62; 詳見本文第二部份之(甲)(乙))。在這寬鬆的法例要求下,各個地區性發展計劃,如新市鎮、開放邊境禁區,與高鐵工程產生的交叉效應,包括空氣污染、噪音、水質下降、地下水文改變等等所帶來的生態影響,這份環評都可「合法地」置諸不顧,但試問這樣去考慮「累積性影響」,又有何意義?

(11) 高鐵環評又充分利用香港環評制度的基本缺陷——只考慮對香港境內的環境影響,而且亦毋須顧及工程的長遠影響。這時空限制在生態問題上是一個致命的失當,因為生態後果不會停在政治邊境上,通常亦不會在短期之內結束。高鐵工程單是挖掘出來的泥石廢料就約有9,785,900立方米,香港自己處理不來的其中5,904,500立方米,高鐵環評建議向中國大陸的台山輸出(高鐵環評Table 10.5),就是一個典型的罔顧境外環境影響的例子。而挖掘出來的共約238,500立方米的沉積物(高鐵環評行政摘要3.41),將會棄置在香港水域,長期危害境內及境外水質,這些,高鐵環評亦沒有深究。

(12) 美國環保局的Noss提出環評在評估生物多樣性時,要注意有不同層級的元素,高層級的元素如氣候轉變、臭氧平流層損耗、背景輻射,都影響較低層級的單位,如地景、生態群落、物種、基因等(Noss 1990)。所以在考慮「累積性影響」時,這些影響廣泛的高層級元素,也不能忽略。

(13) 最終來說,環評需要的是一個強而有力的跨科際角度,才能真正識別生態環境問題之所在,從而作出有意義的預測與評估(Levins 2008)。如此說來,所謂「累積性影響」的計算,是不能不包括社會及文化特質。在香港,最有影響力的社會文化因素包括:人民長期被灌輸以發展主義(Bowers 2001; Sachs 1997)、大都會想像、農耕自足社會就是落後、應大力開發新界為「副都市」及讓全國高鐵「為新界的發展提供重要契機」(公共專業聯盟2008)。在此等社會、文化前提下,生態的可持續性本來就岌岌可危,再加上高鐵項目製造「快就是好」、「基建就是好」、「(西九)文化是高檔次消費」等社會、文化訊息,更強化了上述那些主流的反生態意識。尤有甚者,這份高鐵環評本身,就對生態懷著偏見,如通篇不斷貶稱各種生物及生境為 “common”, “of low ecological value”, “of low potential value”……這也是一種反生態的社會文化價值觀,應被納入「累積性(負面環境)影響」中計算。


(丙) 法例容許環評在短期內倉卒完工

(14) 在香港,很多工程都要火速上馬,環評要「配合」就會採用最低標準中的最低標準。高鐵環評的所謂「田野調查」(即數物種)就只做了六個月(2008年7月至10月定為濕季,11月至12月定為乾季)。上述已提過,Fellowes等學者指出按其「受關注物種」表列去做環評的調查,是現時缺乏足夠生態知識下的起碼工序,試問,單單於工程的地面部份,六個月內每個地點做幾日數物種工作,有如拍幾張snapshots,又如何能夠認真了解高鐵工程會不會傷害到「受關注物種」呢?

事實上,兩位香港生態學權威學者Dudgeon & Corlett亦指出,沒有足夠時間去做多次、重覆的研究調查,對結構複雜的生境(如樹林)的物種豐富程度是談不上了解的;簡略的調查,只會發現這些結構複雜的生境中的物種,與簡單生境(如草地)的物種是差不多的,這樣的調查是毫不準確的(Dudgeon & Corlett 2004, p.232, pp. 236-237)。高鐵環評的嚴重失實調查結果(註6),正好印證了這兩位學者的憂慮。

(15) Dudgeon & Corlett更指出,即使在香港這有限的土地範圍,不同地點的同一物種也會有舉足輕重的基因差異,所以,最少要在稀有品種方面,不單要保護在某個地方的一個品種,而是要保護該品種的不同群落,這才足以維護該品種的基因庫,而有基因多樣性,才可以確保物種能夠面對環境壓力(ibid., p.209; Murphy et al. 1990; Lindenmayer & Fischer 2006, p.74 )。

哈佛大學的John Rock Professor of Population Sciences Richard Levins早在1970年就提出 “metapopulation”理論,自此,很多研究都發現,在被改動過的環境裏,那些分佈在各個區域的物種群落,比起同一物種以單一群落模式存在,更能保障該物種的生存機會。(Levins 1970; Hanski 1997; Lindenmayer & Fischer 2006, p.56-58; Speight et al 2008, p.356, p 370; Murphy et al 1990)。高鐵環評沒有做任何這方面的背景研究,憑數數物種就指工程沒有生態影響,其匆促草率,可見一斑。

(16) 再者,環評以最多一年半載(其間的數天)去數物種,根本就沒有量度物種的形態特質(morphological characters,如昆蟲的對稱性、兩棲及爬蟲類的重量—體積比),故此亦無從理解有關物種所承受的環境及基因壓力,以正確預測其存活趨勢(Hoffmann & Parsons 1993, pp.103-108; Noss 1990; Landres et al. 1988)。


第二部份:高鐵環評違反環評條例


除了犯上環評條例的先天缺陷所容許的各種失準之外,高鐵環評亦犯了多項基本的知識及操作上的缺失,令其科學性及可信性更加低落,亦違反環評條例,環保署署長若然真的秉公辦事,就不應接受這份環評。

首先,Study Brief 3.4.8.2要求「就生態評估所作的調查範圍須包括鐵路沿線及相關工地……以及有機會受影響地方的方圓500米」,高鐵環評在生態評估的一章卻開宗明義說:因為高鐵是一條地下鐵路,不會傷害生境、改變水文、產生噪音問題,因此毋須做沿線的生態評估,環評只需就鐵路的地面部份(幾個通風樓及一些鐵路配套設施)方圓500米範圍作生態評估,便已足夠 (高鐵環評3.27)。我們在此特別就地下水文(見下文(甲))及噪音的生態影響(見下文(乙))方面,指出高鐵環評的違例之處。

(甲) 高鐵環評完全無視要評估工程對地下水影響的法例要求

(17) 高鐵環評在生態評估的一章就開宗明義說:因為高鐵是一條地下鐵路,不會傷害生境、改變水文、產生噪音問題,因此毋須做沿線的生態評估,環評只需就鐵路的地面部份(幾個通風樓及一些鐵路配套設施)方圓500米範圍作生態評估,便已足夠。(高鐵環評3.27)

以下,我們會先就地下水文方面,去說明在地下建鐵路會對地下與地面產生生態影響,所以高鐵環評刻意不做鐵路沿線的生態影響,是嚴重違反環評條例——Study Brief 3.2 (iv) 要求高鐵環評必須研究「工程在施工時及營運時對地下水位的影響…以及此影響所導致的生態及對漁業的潛在後果。」 (原文為英文)

(18) 高鐵環評Appendix 11.8的水文地質(hydrogeology)報告既不研究鐵路工程對地下水文乃至有關的生態的影響,卻專注討論地下水對施工的影響(註7)。但即使如此,報告也不得不一開始就承認「水文地質研究有不確定性」(1.5),甚至會由於水文改變而出現驚人的情況——「擬建的隧道工程可能導致地下水不受控制地湧入挖掘中的工地,因而有地下水位下降的風險;而地下水位下降會引起上層土壤的沉降,及破壞地面建築及設施。」 (水文地質報告7.3.1)。這還不是地底水文與地面情況有緊密關係的最佳說明嗎?何況,這種緊密關係早已是一個公認的學術研究範疇,一個例子就是地下水文改變可能引起地震 (Ingebritsen et al. 2006)。

(19) 這份水文地質報告既承認水文地質研究存在不確定性,卻不就此特定工程去做應做的調查研究(如鑽孔探測、地下水監測、實地及實驗室分析)以減低這個不確定性,令這個報告在生態及環境評估方面做得較接近真實,較有根據。反之,它只是一味開脫責任,公然聲稱「在沒有為此特定工程做的調查資料之下,本報告主要依靠其他人的檔案資料作分析,這些資料的正確性並沒有保證。」又說「任何使用本報告的人士須判斷其中的資料是否適用,並自行作詮釋。」(水文地質報告1.5) (註8) 試問,任何市民、任何政府怎能接受一個花費了巨額公帑卻連基本水文地質影響評估都沒有做到的所謂環評?

而高鐵環評竟然還可以總結「本工程項目亦研究了對地下水的影響。評估結果指出,實施適當的緩解措施後,擬建的隧道工程將不會對地下水體系引起不能接受的影響。」(高鐵環評行政摘要3.44),可謂厚顏無耻之至。

(20) 高鐵環評的總結部份,既然強行指工程對地下水文無甚影響,當然亦不會進一步顧及地下水文改變帶來的生態影響。且看報告是依靠怎樣的「理據」來達成這個總結的:

「理據一」:具結晶質的基岩層(crystalline bedrock)的滲水性低(low permeability),所以被指為不會有地下水流經(no flow boundary)(水文地質報告5.2),而地底大部份就是基岩層。據此,報告便說隧道工程對地下水文沒有甚麼影響。

「理據二」:雖然施工時會出現地下水位下降,但可將下降水平控制在兩米之內,所以影響不大。而且完工之後地下水位會回復舊觀。

(21) 回應第一個「理據」,只需閱讀一遍水文地質報告的 (5.1.2) – (5.1.3) (註9),便能清楚掌握其自相矛盾及胡言亂語之處。該處指出,由於隧道經過的基岩有不少斷層(faults)及破裂帶(fractures),基岩中極有可能有地下水流,例如在上葵涌,隧道會經過破裂了的斷層及侵蝕較嚴重的岩石,故該區有地下水流的機會很大。(水文地質報告Table 5.1)

事實上,基岩中的斷層及破裂帶,可以引致複雜而流量不少的地下水系統出現,已是行內的基本常識(Stober & Bucker 2000;Fetter 1994, pp. 340-343, 356-361; Jiao & Nandy 2001),瑞士Federal Institute of Technology幾位工程地質學教授的綜合研究報告 “Environmental impacts of tunnels in fractured crystalline rocks of the Central Alps”亦清楚指出,在具結晶質的基岩層中興建地下隧道,會令地下水位下降,會改變地下水流的方向,會令地面的河流乾涸,地面也會沉降(Loew et al. 2007; Zangerl 2003)。有專業操守的環評專家焉可坐視不理?

(22) 回應第二個「理據」:

所謂施工時出現地下水位下降可控制在兩米之內,而且完工之後地下水位會回復舊觀,故此影響不大,實在是未經調查之言。例如鐵路經過的米埔、牛潭尾、大江埔、石崗等地段,位處石灰岩層(limestone)地帶(Langford et al. 1989, p.30; 土力工程處2007, p.46),如屬水蝕石灰岩地形(karst),則地下水系統便會十分複雜,連水文地質顧問公司自己的專家也在2004年一篇論文中說明在這些地帶進行隧道工程有很高危險性,一般須為工程進行風險評估(Wallace & Rule 2004)。在這情況下,要將工程進行時水位下降控制在兩米之內,跡近乎不可能,工程完成後要還原水文情況,更是難上加難。而該等地帶的生態重要性,是早有定論的。還需要注意的是,大江埔和石崗乃農業(特別是有機農業)的重要基地,即使只是改變2米的地下水位,也會帶來致命影響。

(23) 另一點必須考慮的,是水文改變也可能改變鹹淡水交界的情況(Chen & Jiao 2007; Fetter, pp. 367-376; Rushton, 49-55; Pielou 1998, pp.49-50; Mitsch & Gosselink 2007, p.135),這對該區的生態有何影響,報告亦沒有評估。即使是微量的鹽份改變,也會對生物帶來影響(Che 1993)。水文地質報告指在地下水位下降引致地陷時,可以採用地下水補注井(groundwater recharge wells)來補救(7.4.5),可是,這些地下水補注井已被證實為容易阻塞,滋生細菌,污染地下水源,至少在美國的威斯康辛州就已完全禁用(Gupta 1995, p.215-216; Fetter 1994, p.533)。

(24) 從更大規模的影響來看,高鐵工程屬於大型地下工程(除了26公里的隧道本身,還有地底建築如通風樓等),香港大學地球科學系的J. J. Jiao教授等學者對海岸地帶的地下工程如何影響高地斜坡的地下水文研究,清楚顯示了地下運輸系統、高樓地基、地下水管、填海工程等,都會逼地下水改向高流,以及改變地下水位對降雨的反應(Jiao et al. 2008; 2006),水文地質報告沒有觸及這方面的改變,是完全說不過去的。

水文地質影響評估涉及的一個重要研究項目,就是地下與地面水體的互動關係(Hu et al. 2007; Winter 1999; Woessner 2000; Rushton 2003, pp.100-143; Pielous 1998, pp.131-138),這些影響正是改變生態的關鍵因素(Dahm 1998; Brunke & Gonser 1997; Fetter 1994, p.31; Tyree 1999; Rundel & Yoder 1998; Chown & Nicolson 2004, pp.87-114; Wilmer 1982, 1986; Danks 2000; Wyman 1988)。試看水文地質報告第75頁Fig. 4.1 Location Plan of Hydrological Features,大家可清楚見到高鐵工程影響的水系除了雞公嶺、錦田河至米埔濕地,更包括大石石澗、大雷石澗、甲龍石澗、大曹(川龍)石澗、大圓石澗等等。由此做成大欖、林村、大帽山、城門郊野公園的生態改變,焉能忽視?

(25) 高鐵環評完全無視這些科學研究,在討論緩解措施時,將視線單單集中在「隧道漏水」問題上,實在令人啼笑皆非。環評又說基於「過去經驗,隧道工程不會導致地下水位下降」(高鐵環評Table 2.15),這些沒有根據的所謂先例援引,雖然有時是受到寬鬆的環評條例所鼓勵,但誰不知無論是水文或是生態的改變,多是緩慢發展,需要長期跟蹤研究才能探測得到(Jiao et al. 2008; Rushton 2003, pp.291-292; Lindenmayer & Fischer 2006, p.95; Brooks et al. 1999; Brooks & Balmford 1996; Bennet 1987; Loyn 1987; Saunders et al. 1993; MacArthur & Wilson 1967)。而事實上,在香港,有哪個工程是有長期(不是一、兩年)跟進其影響的紀錄?可見,這些所謂過去經驗的引用,到頭來只是以錯掩錯,習非成是。


(乙) 高鐵環評完全無視要評估工程噪音的生態影響之法例要求

(26) Study Brief 3.4.8.4(vii) (b)要求高鐵環評「處理施工及營運時做成對生態的騷擾,例如增加噪音、灰塵、排出的廢水,及其他環境質素的下降」。然而,在噪音方面,高鐵環評只評估在所謂 “noise/vibration sensitive receivers”(如醫院、學校、住宅)中會接收到的聲量(dBA)。(高鐵環評第5、6章)

高鐵是個極大規模的工程(註10),建造隧道時會使用鑽爆(Drill and blast)、鑽挖(Tunnel Boring Machine)及明挖隨填(Cut-and-cover)三種不同方法;建造豎井、緊急救援入口和高鐵總站亦會用明挖隨填方法;此外還有各種地盤噪音和機械震動,除了聲量問題,一些低頻率(low frequency,一般指400Hz或1kHz以下)的聲波,經空氣及地層傳遞,也會對生物做成很重大的影響。英國政府於2003年出版的 “A Review of Published Research on Low Frequency Noise and its Effects”就列出了低頻率聲波對人類及實驗室動物做成的各種生理及心理損害(DEFRA 2003)。

再者,眾所周知,生物的感官與人類的大不相同,動物之間、植物之間、動物與植物之間的溝通,是一個表面上難以想像的世界。但長久以來,已有不少相關的研究。舉例說,在聽覺方面,人類可以聽到 20 Hz至20 kHz範圍的聲波,蛾的聽覺範圍大概是20k -50 kHz (Waters 2003; Simmons & Conner 1996),狗可以聽到高達45 kHz,貓是85 kHz,蝙蝠和海豚則甚至會使用100 kHz以上的超聲波溝通。對鳥類和兩棲類來說,聲音更是非常重要的令同種間、甚至異種間進行溝通及避敵的方法,即使是細微的頻率差異也很重要——特別在學習階段和繁殖階段 (Trainer & McDonald 1995; Gerhardt & Huber 2002, pp.44-45; Lindenmayer & Fischer 2006, p.66; Dooling 1982)。另一方面,生物會利用低頻率(少於100Hz)聲波作長距離溝通,因為愈低頻率的聲波可以傳遞得愈遠,而且不只透過空氣,更是透過地層傳達訊息(Payne et al. 1983; Uhlenbroek pp.188-189);生物之間的溝通,一旦受到干擾,覓食、覓偶、遷徙、育幼等方面都會出問題,甚至因而導致物種滅絕(註11)。

(27) 另一方面,兩棲類、爬蟲類以及在地面/地底活動的小型哺乳類動物對地層震動十分敏感(Hetherington 1985; Narins 1990; Barnett et al 1999; Hartline 1971; Uhlenbroek 2002, pp. 186-190; Bouskila 1995; Swaisgood et al. 2003; Narins et al. 1992; Willi et al. 2006)。細小的昆蟲通常只能發出高頻率的聲音(10k Hz以上),然而,高頻率的聲音很容易受風、植物、空間濕度等因素影響而減弱,也會吸引捕食者的注意;再者,很多昆蟲一生只會很隱閉地生活在細小的範圍甚至只在一棵宿主(host plant)上,因此,很多昆蟲會利用其棲身的植物傳遞低頻率的震動信息(低於100Hz,即很多機械運作時發出的頻率),這些震動通過植物的葉、莖和根系傳遞到附近的植物上,令牠得以吸引異性(Michelsen et al. 1982; Cokl et al. 2000; Uhlenbroek 2002, pp. 183-185)。總的來說,物種透過震動去進行溝通、捕食、偵察捕食者的例子,在科學學術期刊中多不勝數,如切葉蟻(Uhlenbroek 2002, p. 196)、蜘蛛 (Masters 1984a, b; Schuch et al. 1990Baurecht et al. 1992)、角蟬(Cocroft et al. 2000)、同翅目(Claridge 1985)、招潮蟹(Aicher & Tautz 1990),皆是如此。

(28) 此外,一些地震研究發現,岩石的受壓和碎裂會引發低頻輻射(low frequency EM wave) 在岩層中傳播——特別是含有壓電(piezoelectric)物質的岩石(如石英) (Asada et al. 2001; Bleier & Freund 2005; Freund 2003, 2006; Mognaschi 2002)。這概念可以解釋地震前夕很多動物出現異常行為,例如冬眠中的蛇從窩中走出,大量蚯蚓在地面出現,以及其他各種動物的不安行為(Ikeya 2004)。

高鐵環評豈能如此明目張膽地無視噪音及地層震動的生態影響?﹗


(丙) 高鐵環評違反環評條例中的「預防的原則」(Precautionary Principle),以歧義、含混的詞彙及錯誤推斷將高鐵的生態影響化歸為零

(29) 讓我們來看看,高鐵環評在有限範圍內做出的生態評價(ecological evaluation),是怎樣的一回事。茲舉大眾熟知有重要生態價值的米埔部份為例。

報告指在研究所及的米埔區內,不同的生境(包括各種農地、魚塘、蘆葦叢/淡水濕地、草場、灌木林、林地、植林地、河道、已發展區/荒地)分別屬於常見(common)、頗常見(fairly common)或非常常見(very common);並指出在此等生境內紀錄到的品種為「主要是常見的品種」(predominantly common species)。在個別地點有一些有保育價值(conservation interest)的品種,但報告指這些品種的絕大部份都是常見的。(高鐵環評 Table 3.24-3.27, 3.30-3.36)

(30) 如果一個環評是用「常見」來證明有關物種及其生境是無需保育或重視(事實上高鐵環評就是採用這個立場),那便是大錯特錯。

首先,一個物種雖然到處可見,但個別地點對該物種來說,仍可能有特別的重要性。例如在香港十分常見的麻鷹(Black Kite),卻只集中在個別地點繁殖及棲息。而被報告稱為「常見」的池鷺(Chinese Pond Heron),便與其他鷺鳥不同,主要在漁塘而少在潮澗帶泥灘覓食。所以,要對某地區出現的生物各自的行為有全面而透徹的了解,才可評估個別地點的生態重要性(Van Horne 1983; Duebbert et al. 1983)。

另一方面,有些生物為數不少並會在生物周期的某些階段一大群地出現,牠們亦往往被理所當然地列入「常見」類。然而,牠們之所以一大群地出現,對牠們這物種的生存來說是很重要的——正是由於有一個大群落,牠們才能在物競天擇的情況下,或得到覓食及繁殖的方便,或保持了體溫及水份,或以群體來抵禦捕食者,終而可讓其基因得以遺傳下去,這就是所謂Allee effects了(Chown & Nicolson 2004, pp.109, 164-165; Claridge, 1985)。

事實證明,因物種的大群出現而誤以為牠們不會面對絕種威脅,是極大錯謬。在1880年代前,每群動輒以20億之眾集體遷徙的北美旅鴿(Passenger Pigeon),在不足20年之內,便完全絕跡於世上(Halliday 1978, pp.87-95)。在香港,最著名的「滅門慘案」就是1980年代本地松樹——尤其是本土品種Masson Pine (Pinus massoniana)——被隨日本木材進口的松木線蟲殺個清光。松樹本來是香港山林的重要部份,經此一役,它們幾乎絕跡於香港的山林景觀(Dudgeon & Corlett 2004, p. 252)。

(31) 一個物種以大數量出現於某類生境中(即所謂「常見」),不但對該物種本身重要,更可能是該類生境得以維繫的關鍵因素。就以米埔中一系列的無脊椎動物為例,根據香港大學動物學學者S.Y. Lee在1993年發表的研究,牠們的大規模存在擔任了重要的分解功能,即對紅樹林的生存是不可或缺的(Lee 1993)。

(32) 報告又指各種農地、草場、灌木林、植林地皆屬高度割裂(fragmented)地區,但籠統地使用「割裂」此詞是含有極大誤導性的:人類覺得割裂的不同地段,對不同生物——甚至對同一科的不同品種——來說,可以不是那麼割裂,甚至不但不割裂,還具有牠們生存所依賴的連繫性(Lindenmayer & Fischer 2006, pp.121-132; Price et al. 1999; Tubelis et al. 2004; Sarre et al. 1995; Manning et al. 2004)。

另外,報告又用了「可再造性」(recreatability)這個概念去評價各種生境,「可再造性」愈高,該生境要受到保護的需要就愈低。米埔的不同生境中,大部份都被評為有高度「可再造性」——除了完全沒有「保育價值」品種存在的林地、要用較長時間但「非常容易再造」的灌木林、及有「中度可再造性」的蘆葦地/淡水濕地之外。生境是否那麼容易去「再造」,其實並不能輕易評估,因為牽涉不同的物種在一個特定地點是如何構成牠們獨特的生態關係(Keddy 2000, pp.55-78, 184-221),這是從理念上說;至於實際上「再造」所遇到的問題,我們會在以下回應,詳見本文第(35)段。

(33) 高鐵環評更用上了掩人耳目、偷天換日的低劣技倆,一方面綜合報告了其他人士以往在工程範圍地帶的生態紀錄,以滿足環評條例的要求,另方面卻在此環評的生態評價部份,完全不提或明顯忽略該等紀錄中的不同類生物——其中還有為數極多是「受關注物種」/ 受香港《野生動物保護條例》(Cap.170)保護的物種。

(34) 高鐵環評在評價各個生境時,既沒有生態知識根據,又隱瞞已有知識,更採用了歧義、含混的詞彙,不難想像,在結論部份,「根據」了此等評價所列出的「高鐵生態後果/裨益」,就更加避重就輕、大放厥辭、前言不對後語,總之就要將高鐵工程對生態的影響化解為零。

報告總結說:在陸地生態方面,「施工區內各個已知的生境,大都只具偏低的生態價值;當中所記錄到的動物和植物,都是香港常見的種類。」「因此預計本工程項目只會造成較低的直接生態影響。」(高鐵環評行政摘要3.4) 又說:「本工程項目對重要地區和具保育價值的物種預計不會造成任何直接影響。」(高鐵環評行政摘要3.6)

我們已在本文第(29) – (33)段對這兩則總結所「根據」的歪論,作出清楚駁斥,不容總結將工程會做成的嚴峻生態處境輕輕帶過。

(35) 報告總結只有兩處提到工程的潛在生態影響,一個是對石崗各種河道的影響,一個是施工及營運階段的間接低影響。總結認為前者可以「採用洪水繞流渠……(和)在露天河道中會加入具生態效益功能的水道,例如在石崗的明渠加上天然河床基底和有植物覆蓋的河岸,為野生動物提供河道生境」(高鐵環評行政摘要3.5),便得緩解。而針對後者,則若採用「設工地圍板、控制徑流、採用不反光的建築物外牆、復原施工區及採用良好的施工方法等」(高鐵環評行政摘要3.7)方法,即可緩解。

將龐大工程的廣泛而未有被好好地評估出來的生態傷害,概括為可以用以上三兩種門面功夫就得以緩解,實在是明修棧道,暗渡陳倉技倆。更何況,報告連施工及營運階段的光害問題(如對夜間動物行動的影響Caro 2005, 89-90; Clarke 1983; Brillhart & Kaufman 1991),也沒有列出及說明緩解方法。事實上,緩解措施絕不是這麼簡單的一回事:每一種生境、每一個地點、其中的每一個生物群落如何在那裏立足、覓食、繁殖、與環境及其他生物互動,都是經歷了十分長久的競爭和許多偶然性因素才演化出來的狀態,不是做三兩個人工措施就可以取代 (Lindenmayer & Fischer 2006, pp.199-200; Keddy 2000, pp.447-478, 503-539)。

特別在香港,歷來所謂的補償措施,其成效如何都沒有任何真憑實據可以提供出來參考;即使是最熱門的濕地補償措施,以西鐵和錦田繞道工程的補償濕地為例,人工建成了沒有幾年,成敗未知,現在高鐵工程竟又在此址上加以破壞(高鐵環評3.113 – 3.115),真是諷刺之至。生態補償在香港之為何物,可想而知﹗


(36) 「廣深港高速鐵路(香港段)」貫穿拉姆薩爾濕地(Ramsar Wetland)、具高生態價值的郊野公園(Country Parks)及緩衝地帶(屬Conservation Areas)、以及具特殊科學價值的地點(Sites of Special Scientific Interest),做成的生態後果可以是十分廣泛而嚴重的,高鐵環評卻一味只是利用詞語把戲、空想無憑的表面緩解措施,將此工程可能引發的非常複雜——因此有極大不確定性——的生態後果,大力調低不特已,還再加以掩藏和銷滅。所以,對有關的十分廣泛而嚴重的潛在後果,自然談不上有甚麼真正的緩解措施。根據香港法例第499章《環境影響評估條例》,環境影響評估程序的技術備忘錄4.4.3 (a) (x),在評價剩餘環境影響(即採取了緩解措施之後還有的影響)時,必須援引「預防的原則」(Precautionary Principle),可見高鐵環評其實已嚴重違反了技術備忘錄4.4.3 (a) (x)。

所謂「預防的原則」,根據Environmental Impact Assessment Appeal Board上訴案裁決書 (上水至落馬洲支線) 的判決,在「拉姆薩爾濕地」、具特殊科學價值的地點及保育地區,是適宜引用「拉姆薩爾公約」(Ramsar Convention on Wetlands)對「預防的原則」的定義來作詮釋,此定義是:假若對某些特定的行為的影響未能清楚了解,則這些行為應被禁止,雖然未有足夠証據證明有關的活動與濕地受損的結果是有直接連繫的。(上訴案裁決書—— “The Precautionary Principle”) 而高鐵環評卻採取了與此原則恰恰相反的立場,即在未了解建高鐵的有關行為對三類高保育價值地的生態影響前,已向建高鐵行為大開方便之門。

對於潛在巨大生態損害的工程及發展計劃,生態學者認為在工程/發展 vs 公眾需要(即生態保育,註12)之間要作取捨時,若面臨不確定因素,疑點應歸於公眾需要那方。這是說,生態後果有不確定性時,寧犯統計學上的Type II error——即出錯於誤認為工程有不良生態後果,也不可犯上Type I error——即出錯於誤認為工程沒有不良生態後果(Shrader-Frechette & McCoy 1993)。這種取決,是基於我們的社會必須採取嚴肅的態度去對待生態破壞:破壞了的生態很難修復,一個物種消失就是永久的消失,一個生境被傷害,我們很多時根本不會知道這些傷害間接促成了甚麼物種日後的滅絕。而人類與生態圈的連繫、人類所需的資源,也因而被削弱。故此,在生態問題上審慎其事、防患於未然,是最低限度的負責任態度;人民要督促政府落實這個態度——當面對這類既違法又毫無生態角度的環境影響評估時,不批准它們矇混過關。

- 長約26公里的地下鐵路,從西九龍的總站伸延至皇崗邊界;

- 七座隧道通風樓,分別設於米埔、牛潭尾、八鄉、城門、葵涌、南昌和旺角西,以及設於大江埔的緊急救援入口;

- 位於石崗列車停放處旁的緊急救援入口。

2.2 除了上述各項主要元素外,本工程項目於施工期間,需要設置後勤施工區、幹道支路、躉船轉運設施、臨時爆炸品倉庫和植物護理區。

2.3 根據「環評條例」,本工程項目包含了下列屬於指定工程項目的元素:
- 鐵路及其相聯車站(「環評條例」附表2第I部A.2項);
- 鐵路側線及維修工場(「環評條例」附表2第I部A.4項);
- 入口之間的長度超過800米的行車隧道或鐵路隧道(「環評條例」附表2第I部A.7項);及
- 項目部分或全部位於現有的郊野公園或特別地區、自然保育區和具有特別科學價值的地點(「環評條例」附表2第I部Q.1項)。

(註11) 如海上航運和聲納探測所製造的低頻率聲波,令到鯨魚須消耗更大能量去發出更高聲浪來達致溝通,而溝通範圍亦由314 百萬平方公里縮小至8,000平方公里,令牠們更難覓偶,也影響遷徙、覓食、育幼;更嚴重者會令鯨魚內耳及腦部出血死亡,導致一些族群的滅絕(Simmons et al, 2004)。

(註12) 「公眾需要」須從一個完備的角度來理解,它不能被化約為短期內的國民生產總值增長,而是必須包含以下的元素:人民身體及精神健康、人民及其後代的生活質素、其他物種的福祉——這亦與人類的福祉息息相關、公眾的道德培育——這關係著責任感這個公眾文化水平的重要部份。這些,都不會增加國民生產總值,反而會被視為不利的因素(例如更多人生病而就醫吃藥,就比少人生病帶來更高國民生產總值)。而這些公眾需要元素,正就是生態保育所蘊含的關注點。

臭罌出臭草,此賬更糊塗 ——我們不接受高鐵環評

香港的環境影響評估(環評,EIA),是由項目倡議人委託做的,因此自然會調節論証,傾向主建一方。

第一部份:環評條例的先天缺陷

「廣深港高速鐵路(香港段)」環評報告) (以下簡稱「高鐵環評」)利用了香港環評條例的先天缺陷,作出嚴重失實的評估,共有三點可以說明。

(甲) 欠缺生態角度,使用粗疏調查方法,收集的數據無代表性


  • 純粹用數個別物種方法,全無生態學上的系統研究。
  • 連香港生態學者呼籲的環評起碼要重視保護「受關注物種」,也沒有遵從。例如在受關注昆蟲中,高鐵環評只調查蝴蝶蜻蜓兩種,對了解其他昆蟲、生物及生境,幫助不大。
  • 高鐵環評調查錄得的物種很少,其他人士在相同地區的調查研究結果又不被納入評估,刻意低估這些地區存在的「受關注物種」。


(乙) 對「累積性影響」採用極狹窄定義,反映不出生態後果的嚴重性


  • 高鐵環評只考慮地面施工範圍500米內的影響,即只考慮500米內的同期工程的累積性影響,這其實是非常荒謬的。舉例說,水文改變、地下傳聲(震動),就能影響以公里計的範圍。
  • 高鐵環評指同期工程的累積性生態影響為低,因為那些地方已經發展,意含可連續受破壞也沒有相干,實在是只知破壞不知修復為何物的反生態角度。
  • 對地區上(珠三角)、香港境內多重政策傾斜下做成的郊野危機(如大環境中已廣泛存在重金屬及持久性有機污染物)都視若無睹,不納入累積性影響須考慮的範圍。
  • 對工程引起的境外污染——如將挖掘出來的沉積物棄置在香港水域,長期危害境內及境外水質,因而引起的交叉效應——也置諸不顧。
  • 高鐵項目製造「快就是好」、「基建就是好」、「(西九)文化是高檔次消費」等社會、文化訊息,令香港本來已存在的蔑視鄉郊、妄談大都會的反生態主流意識,更進一步擴張。這些都沒有納入累積性影響中。

(丙) 法例容許環評在短期內倉卒完工

  • 香港環評條例只要求六個月內、在每個地點做幾日數物種即符合規定,這樣「高速」又如何能夠認真了解工程會不會傷害到「受關注物種」呢?
  • 香港生態學學者指出,結構複雜的生境(如樹林)的物種豐富程度,非多次、重覆研究調查不會知道。可見高速環評並不可靠。
  • 不同地點的同一物種也會有舉足輕重的基因差異,所以,在沒有對物種基因作研究的情況下,就要盡量保護不同地點出現的物種以保護該品種的基因多樣性。高鐵環評匆促倉卒指工程對物種沒有影響,是不負責任的。
  • 在短時間內單憑數物種去了解生境的重要性,而沒有對物種的形態特質進行研究,並不能知道其承受的環境及基因壓力,故亦無法預測其存活趨勢。


第二部份:高鐵環評違反環評條例

除了犯上環評條例的先天缺陷所容許的各種失準之外,高鐵環評亦公然違反環評條例,環保署署長若然真的秉公辦事,就不應接受這份環評。

高鐵環評Study Brief 3.4.8.2要求「就生態評估所作的調查範圍須包括鐵路沿線及相關工地……以及有機會受影響地方的方圓500米」,高鐵環評在生態評估的一章卻開宗明義說:因為高鐵是一條地下鐵路,不會傷害生境、改變水文、產生噪音問題,因此毋須做沿線的生態評估,環評只需就鐵路的地面部份(幾個通風樓及一些鐵路配套設施)方圓500米範圍作生態評估,便已足夠 (高鐵環評3.27)。我們在此特別就地下水文(見下文(甲))及噪音的生態影響(見下文(乙))方面,指出高鐵環評的違例之處。

(甲) 高鐵環評完全無視要評估工程對地下水影響的法例要求

  • 高鐵環評Study Brief 3.2 (iv) 要求高鐵環評必須研究「工程在施工時及營運時對地下水位的影響…以及此影響所導致的生態及對漁業的潛在後果。」
  • 環評不研究鐵路工程對地下水文乃至有關的生態的影響,卻專注討論地下水對施工的影響。但即使如此,報告也不得不承認「水文地質研究有不確定性」,甚至隧道工程可能導致上層土壤的沉降,及破壞地面建築及設施。
  • 環評卻不就水文地質的不確定性,去做應做的調查研究,以便更好地評估生態及環境影響。它只是一味開脫責任,叫使用本報告的人士「去自行判斷其他人的檔案資料是否適用,並自行作詮釋」,可謂極不負責任。
  • 環評總結工程對地下水文無甚影響,亦沒有相應的生態影響,「理據」有二:

    「理據一」:地底大部份是基岩層(bedrock),而基岩層的滲水性低,所以不會有地下水流經。[回應:報告自相矛盾地指出隧道經過的基岩有不少斷層(faults)及破裂帶(fractures),基岩中極有可能有地下水流。話雖如此說,又不去做研究。]

    「理據二」:雖然施工時會出現地下水位下降,但可將下降水平控制在兩米之內,而且日後地下水位會回復舊觀。[回應:在新界西北,石灰岩層十分普遍,施工時水位下降會做成甚麼影響、是否那麼容易恢復,根本只是胡亂猜測;水位改變影響該地區的(有機)農業,又沒有考慮及評估。]

  • 地下水文改變也可影響鹹淡水交界的情況,對該區造成的生態影響,報告亦沒有評估。
  • 有研究指出大型地下工程會影響高地斜坡的地下水文,逼地下水改向高處流,以及改變地下水位對降雨的反應,這些,報告也完全沒有觸及。


(乙) 高鐵環評完全無視要評估工程噪音的生態影響之法例要求

  • Study Brief 3.4.8.4(vii) (b)要求高鐵環評「處理施工及營運時做成對生態的騷擾,例如增加噪音、灰塵、排出的廢水,及其他環境質素的下降」。然而,在噪音方面,高鐵環評只評估在人類使用的設施中會接收到的分貝。
  • 高鐵建隧道時會使用鑽爆、鑽挖及明挖隨填三種不同方法,此外還有各種地盤噪音和機械震動,施工時發出的低頻率聲波,以及地層震動,對各種生物的影響十分重大。物種的溝通、覓食、偵察捕食者、覓偶、遷徙、育幼,都會由之受到干擾,這些生態影響,怎能說愛不做評估就不做評估?
  • 一些地震研究發現,岩石的受壓和碎裂會引發低頻輻射在岩層中傳播,就如同地震前,動物會感受到而出現異常及不安的行為。


(丙) 高鐵環評違反環評條例中的「預防的原則」(Precautionary Principle),以歧義、含混的詞彙及錯誤推斷將高鐵的生態影響化歸為零

  • 報告指在研究所及的生境中絕大部份都只有「常見品種」,並以此來「證明」有關物種及其生境是無需保育或重視。這推論的錯誤在於不了解
    (1) 常見物種也需要特定的地點(如去繁殖、棲息或覓食)才能生存,故不可隨便破壞牠們出現的地點。
    (2) 生物大群地出現往往是其生存方法,數目多不表示「多餘」。
    (3) 常見甚至數量極多的品種一樣可以在短期內絕種。

  • 大數目出現的物種可能對有關生境有重要功能,如米埔中一系列的無脊椎動物有分解功能,對紅樹林的生存不可或缺。
  • 報告更採用一些含混、歧義的詞彙,例如指生境「割裂」(fragmented)或有高度「可再造性」(recreatability),去引導出有關地點沒有生態重要性,然而,人覺得割裂的不同地段,對不同生物來說,可以不但不割裂,還具有牠們生存所依賴的連繫性;「可再造性」更不是隨便說的,因為牽涉不同的物種在一個特定地點如何構成牠們獨特的生態關係,不是說可再造就可再造。
  • 報告總結只有兩處提到工程的潛在生態影響,又提出用三兩種(門面)功夫便可輕易緩解。
  • 上述種種,都是違反環評條例,原因是條例中技術備忘錄4.4.3 (a) (x)指出,在評價剩餘環境影響時,必須援引「預防的原則」。按Environmental Impact Assessment Appeal Board上訴案裁決書 (上水至落馬洲支線)的判決精神,在「拉姆薩爾濕地」、具特殊科學價值的地點及保育地區,是適宜引用「拉姆薩爾公約」(Ramsar Convention on Wetlands)對「預防的原則」的定義來作詮釋,此定義是:假若對某些特定的行為的影響未能清楚了解,則這些行為應被禁止,雖然未有足夠証據證明有關的活動與濕地受損的結果是有直接連繫的。


這就是說,對高鐵所經的大片香港珍貴郊野環境一個依法而做的環境評估,必須是寧可錯誤高估也不可錯誤低估生態影響,因為生態破壞的災難性影響並不是好像環評報告經常指出的那般,是可以輕易補償過來的,物種的消失,是永不回頭的。






From Minimal Compliance to Outright Violation of EIAO
— Critical Comments on EIA of Guangzhou-Shenzhen-Hong Kong Express Rail Link (Hong Kong Section)

In Hong Kong, environmental impact assessment (EIA) is commissioned by the project proponent. It is inevitable that the EIA of Hong Kong Section of Guangzhou-Shenzhen-Hong Kong Express Rail Link (hereafter XRL EIA), like its precedents, is prepared with the interests of commissioning party in mind.

Part I: Congenital defects of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) being exploited by XRL EIA

The XRL EIA takes advantages of the congenital defects of Hong Kong’s EIAO to make grossly erroneous ecological assessment. Follows are three points for illustration.

(A) Lacks ecological perspective; uses crude survey methods; collects non-indicative data


  • The XRL EIA relies solely on counting individual species, neither engaged in nor making reference to systematic ecological studies.

  • Disregards the plea of local ecologists to pay attention to “fauna of conservation concern”. For example, among the insects of “conservation concern”, only butterflies and dragonflies are surveyed, which is not helpful in understanding other insects and life forms and the habitats.

  • The number of species recorded by the XRL EIA is low; survey results conducted by others in the same regions are not included in the ecological evaluation of the habitats. The number of species of “conservation concern” is underestimated apparently.

(B) Defines “cumulative impacts” narrowly which fails to reveal severe ecological consequences

  • The XRL EIA considers impacts only within 500 meters of aboveground works areas, hence, only cumulative impacts of concurrent projects within 500 meters are taken into account. This is in fact very ridiculous. For example, hydrological alteration and groundborne noise (vibration) can affect areas kilometers away.

  • The EIA concludes that cumulative ecological impacts of concurrent projects are low because the works areas are already developed, signifying that successive damages are allowed while paying no regard to ecological restoration. This is indeed a stunningly anti-ecological stance.

  • Multiple risks to the countryside owing to policy measures within the region (Pearl River Delta) and Hong Kong territories (such as the widespread existence of heavy metals and persistent organic pollutants in the environment) are not taken into account in the cumulative impact assessment.

  • Disregards pollution caused by the project outside the boundary of Hong Kong—for instance, sediments excavated will be dumped in Hong Kong waters and jeopardize Hong Kong’s and neighboring water quality in the long term and cause synergistic impacts.

  • The XRL project conveys the social and cultural messages that “speed is everything” , “infrastructure is good”, “consuming ‘culture’ (at West Kowloon) is chic”—further reinforcing the anti-ecological mainstream ideology that puts down the rural and aspires to the metropolitan.

(C) EIAO allows EIA to rush through within a short time period

  • The EIAO sets a minimal requirement of a six-month ecological survey—which can be accomplished by counting species for a couple of days at each site within that period. How can such an “express” EIA recognize the harm caused by the project to “concerned species”?

  • Ecologists in Hong Kong have pointed out that species diversity in structurally complex habitats (such as woodlands) can only be learned through numerous and repeated survey. Hence, the XRL EIA conducted in such haste is basically unreliable.

  • Genetic variation among individuals of the same species at different localities may be substantial. Therefore, without existing studies of species genetics, species populations at different sites should be protected for their genetic diversity. It is irresponsible for the XRL EIA to conclude that the project causes no harm to different species without detailed studies.

  • The XRL EIA counts on species number (surveyed in a short duration) to evaluate the significance of different habitats. No studies have been conducted on the morphological features of the species which could indicate environmental and genetic stresses. Hence the survival trend of individual species cannot be accurately predicted.


Part II: The XRL EIA violates the EIAO

Apart from the inaccurate assessment permitted by the congenital defects of the EIAO, the XRL EIA openly violates the EIAO. A responsible Director of the Environmental Protection Department should REJECT this EIA report.

The XRL EIA Study Brief 3.4.8.2 requires that “(t)he study area for the purpose of ecological assessment shall include all areas within a distance of 500m from the boundaries of the railway alignment and all associated areas under the Project, such as terminus… and the areas likely to be impacted by the Project.” The XRL EIA report, however, states that the underground portions of the railway alignment are excluded from the ecological impacts assessment (3.27). Reason given being the project alignment, running underground, will cause no loss of habitat, minimal disturbance to groundwater and surface water features, and negligible groundborne noise impacts. It therefore considers an ecological assessment covering 500 meters of the aboveground works areas (such as ventilation buildings and other railway facilities) as sufficient. We shall highlight how the hydrogeological (see Part A below) and noise impacts (see Part B below) have been neglected by the XRL EIA.

(A) The XRL EIA disregards the legal requirement of assessing impacts to the underground water by the project

  • The XRL EIA Study Brief 3.2 (iv) requires the XRL EIA to study “the impact to the underground water table due to the construction and operation of the Project… and the related potential ecological and fisheries impacts arising from the above impacts.

  • The XRL EIA focuses on the impacts of underground water on the project instead of the impacts of the project on underground water and ecology. Even so, the Hydrogeological Impact Assessment Report (Appendix 11.8 of the EIA) has to admit that “(k)ey limitations of this report relate primarily to the uncertainty with respect to the ground and hydrogeological conditions along the alignment” (1.5) and “there is the possibility that the proposed tunneling works may result in uncontrolled groundwater inflows into the excavation with the consequent risk of groundwater drawdown. Drawdown could result in settlement of the overlying soil strata and damage to existing surface features such as buildings and utilities.” (7.3.1)

  • In view of the uncertainty, the EIA, however, did not conduct necessary project specific ground investigation works to better assess the project’s impacts on ecology and the environment. Instead, it says “any persons who intend to use any information contained herein shall assess the applicability of the (archival) information (reported by others) and carry out their own interpretation.” (1.5)

  • The XRL EIA concludes that there are no hydrogeological and corresponding ecological impacts based on two “arguments”:

    “Argument 1”: There is little to no flow through the bedrock due to the crystalline nature of both the granitic and volcanic rock masses. [Response: The report, contradicting itself, points out that the tunnel alignment will pass through many geological faults and fractures which may act as conduits to substantial groundwater flow. In any case, no project specific investigations have been carried out.]

    ”Argument 2”: Even though there is potential water table drawdown, the drawdown can be limited to 2 meters, and the water table level will resume in future. [Response: The NW New Territories is underlain by marble. Is it so easy to recover water table drawdown? How such change in the underground hydrology will affect (organic) farms in the region is also not assessed.]

  • Change of underground hydrology will alter the equilibrium of the saltwater/freshwater interface. What impacts are there on local ecosystem are not assessed.

  • Researches have shown that large underground works will affect underground hydrology of nearby highlands, forcing the underground water to flow upwards and changing the response of water table to precipitation. The XRL EIA has not even touched on these effects.

(B) The XRL EIA disregards the legal requirement of assessing ecological impacts of noise generated by the project

  • The EIAO Study Brief 3.4.8.4(vii) (b) requires that the EIA addresses “(t)he ecological impacts due to disturbance during construction and operational stages of the project such as increase in noise, dust, effluent discharges or other deterioration of environmental quality.” However, with regard to noise, the XRL EIA only assesses the noise received at facilities used by humans.

  • Drill and blast, Tunnel Boring Machine and Cut-and-cover will be used in construction of the tunnel. In addition, there are noise and vibration generated by Powered Mechanical Equipments. The low frequency noise and vibration can cause severe impacts and interference to species communication, feeding, detecting predators, finding mates, migration and nurturing their juveniles. How can the XRL EIA not assess these ecological impacts?

  • Earthquake studies have shown that the compression and fracturing of rocks induce low frequency electromagnetic waves which will propagate through rock layers, in part explaining the abnormal and stressful behaviours of animals before major earthquakes.

(C) The XRL EIA violates the Precautionary Principle as required by the EIAO, and reduces the ecological impacts to null by using vague and/or ambiguous language and erroneous arguments.

  • The XRL EIA claims that predominantly “common species” are present in the habitats within the study area, hence demonstrating that the recorded species and habitats are of low conservation value. The fallacy of such argument include the ignoring of the followings:
    (1) Common species may depend on specific sites for their survival (e.g. breeding, roosting or foraging). Sites where they are spotted should not be damaged heedlessly.
    (2) Aggregation is often the species’ survival strategy. The great number does not indicate “redundancy”.
    (3) Common species or even species with a huge population can go extinct within a short period of time.

  • Large population of certain species may play an essential role in the ecosystem. For example, a series of invertebrates at Mai Po act as special decomposers and are indispensable to the survival of the mangrove forest.

  • The XRL EIA uses vague and/or ambiguous language—such as habitats are “fragmented” or with high “recreatability”—to establish that the sites are not ecologically important. However, habitats may “look fragmented” to humans but are in fact connected for different species. “Recreatability” cannot be based on superficial understanding of the habitat: it involves understanding how different species at a specific location relate ecologically to each other. The evolution of such relations requires a lot more than simple replication of certain apparent conditions.

  • The XRL EIA concludes that there are two potential ecological impacts which can be easily mitigated by a few superficial measures (such as good construction site practices and hoarding).

  • All the above constitute violation to the EIAO as Technical Memorandum 4.4.3(a)(x) points out that in evaluating residual environmental impacts the precautionary principle shall apply if the adverse environmental impacts are uncertain. According to the Judgement of Environmental Impact Assessment Appeal Board (Sheung Shui to Lok Ma Chau Spur Line), the definition of Precautionary Principle in the Ramsar Convention on Wetlands applies to Ramsar sites and no doubt is appropriate when applied to Sites of Special Scientific Interest and Conservation Areas, which is:

    “If the impact of specific actions is not clearly understood, then these actions should be prohibited even if there is insufficient evidence to prove a direct link between the activities and resulting wetland degradation.”

  • This is to say, an environmental impact assessment of the Express Rail Link that passes through large areas of the precious countryside of Hong Kong, observing the Environmental Impact Assessment Ordinance, should rather overestimate but never underestimate the adverse ecological impacts. This is because, unlike what the XRL EIA repeatedly points out, disastrous consequences of ecological damage cannot be easily compensated or reverted. Once a species vanishes, it vanishes forever – be that due to human negligence, greed or ignorance.

    「廣深港高速鐵路(香港段)」對香港將帶來的環境破壞,大家已有不少理解,部份朋友更參加反對行動。那邊廂,曾某與港府與大部份立會議員視高鐵為香港救星,最多只在「走線」方面——如經不經菜園村——有不同意見。主建目前仍是主流意見。

    在這情況下,反對高鐵實不容易。

    所以,我們只有繼續盡量揭露高鐵的粗暴傷害香港之處,讓更多市民從而認清香港人不應做基建/建築商/發展商的奴隸,我們應另有合理、人道、愛萬物的美好生活議程。

    2009年7月21日,高鐵環評已在網上刊出了,一如所料,為工程大開綠燈,粗疏錯謬百出,我們將其問題分為兩大項:(一)盡量利用法例向主建者寬大之處,草率行事;(二)連法例的最低要求也達不到。基於此(尤其是基於(二)),我們大可督促環保署署長否決這份環評報告,至少要港鐵重做。

    高鐵環評公眾諮詢期將於2009年8月19日屆滿,如果環保署總結反對意見之後還是放水,又如果有良心律師肯出馬,則可以控告政府;如果沒有,則起碼可在市民面前撕下政府最後一副假面具。
